SERVICE TERMS AND PRIVACY POLICY

Article 1: User account terms

You must be at least 18 years old to use GoSELL services.

You must provide your full name, address, accurate email and other relevant information to use our user support policy.

GoSELL will use your email as the primary method of communication between both parties.

You must keep your password confidential. GoSELL does not commit to responsibility for any damage to users if it comes from your failure to keep your password secure.

You are fully responsible for the data, images, reports and website (links) that are uploaded to your GoSELL account (referred to as your 'Online store'). You are not allowed to introduce any virus or code that affects your GoSELL account or the GoSELL management provider system.

If there is any violation of the Terms of Use, all services you use of GoSELL will be terminated immediately.

When you register an account on GoSELL, you will be supported in opening an additional sales account on the GoMUA e-commerce platform (if you do not have one).

Article 2: Activate account

The person registering for the service will be considered the account owner and bound by the entire Service Terms.

If the person registering to use GoSELL's services is your employee, then your employee is the account owner.

Article 3: General conditions

You must read and agree to the entire Service Terms before becoming a GoSELL user.

GoSELL provides you with a service package that involves a usage period and a price on the contract at the time of signing. You have the right to utilize this service bundle within the specified period. Following the registration period, the service will be temporarily locked or terminated.

You may not use GoSELL's services for any illegal activities. This applies to the laws of each country where you do business, including Vietnamese law.

You are not allowed to copy, sell or use these Terms for personal purposes without the written authorization of GoSELL.

You are also not allowed to use any Marketing tools related to Search Engine or keyword purchasing methods (such as Google Adwords) that contain copyright images and GoSELL logos.

You should be aware that the content information on your website (excluding credit card information) will not be encrypted for security like credit card information.

You confirm that you understand and agree that you will be bound by these Service Terms and Privacy Policy.

Article 4: GoSELL's rights

We have the right to modify these Service Terms that is relevant to our business strategies.

We have the right to remove content or any account that contains illegal, offensive, defamatory, threatening, pornographic or intentionally infringes intellectual property.

We have the right to delete any account that intentionally violates or insults, whether verbally or in writing, GoSELL customers, GoSELL employees, or GoSELL company.

GoSELL does not preview or approve any information content on the user's website. Users are responsible for their content.

We have the right to provide services to your competitors or commit to being exclusive to any partner for any segment.

In the case of a disagreement regarding account ownership, we reserve the right to seek papers that establish your account ownership. Documents may include, but are not limited to copies of your business license, identification card, etc.

GoSELL has the right to decide on the legal ownership of the account and may transfer this right to the valid owner. If we are unable to identify actual ownership, GoSELL will freeze this account until the dispute is resolved.

Users are not allowed:

- Violate the law, the rights of third parties or GoSELL's Prohibition Policy;

- Use the service to impersonate or misrepresent any person or entity;

- Modify titles or edit formatting to disguise the origin of any content of the service;

- Remove any proprietary information from GoSELL;

- Cause any modification or creation of derivative works from translations of the Service without GoSELL's permission;

- Use the service for fraudulent purposes. Edit the price of any product or interfere with another user's catalog of goods. Committing acts of sabotaging GoSELL's rating or feedback recording system;

- Intentionally reverse, delete, or hack GoSELL's tools (or any of its parts), break encryption technology barriers, or create security barriers related to GoSELL services or stored information transferred, processed, and stored by GoSELL.

- Harvest or collect any information related to User accounts, upload, post, email or public any content that is not permitted under any law or contractual relationship, any entrustment (internal information, proprietary information that needs to be kept confidential or disclosure of labor relations without authorization); or upload, post, email, transmit or public any content that infringes any patent, trademark, trade secret, copyright or any other proprietary interest of any whichever side; or upload, post, email, transmit or public any unauthorized or unlawful advertising, promotional materials, "junk mail," "spam," "chain letters." ", or any other form of advertising; or upload, post, email, transmit or public any material that contains viruses, trojan horses or any other computer code, files, or programs designed to interfere with, destroy or limit the functionality of computer hardware, software, or telecommunications equipment.

- Interrupting conversations, accelerating the screen speed faster than normal to edit or perform operations that negatively affect the user's ability to participate in real transactions or interfere, control or disrupt the service, server, network connected to the service or the user's use of the service or do not complying with network requirements, procedures, policies and laws related to GoSELL;

- Acts or participates in directly/indirectly destroying, disabling, overloading, or weakening GoSELL, servers or networks connected to GoSELL;

- Use GoSELL to violate local, national, or international laws, regulations, directives, instructions, or policies (whether or not in effect) intentionally or unintentionally related to the Department of Health. anti-money laundering or anti-terrorism;

- Use GoSELL to violate or circumvent any penalties or embargoes administered or enforced by relevant authorities.

- Use GoSELL to violate the privacy of others, stalk or harass other users, or infringe on GoSELL's rights, including intellectual property rights and reputations attached to it. Use the service to collect or store personal data of other users in connection with the prohibited acts and activities mentioned above; list goods that infringe on the reputation, trademark and other intellectual property rights of third parties; and use services on GoSELL in ways that may infringe on the intellectual property rights of third parties.

Article 5: Limitation of liability

You must clearly understand and agree that GoSELL will not be responsible for any damages, whether direct/indirect or incidental, especially damages to profits, reputation, use rights, data, or other invisible damages when using the service.

In all cases, GoSELL or other service providers cooperating with GoSELL will not be responsible for loss of profits or other consequential damages arising from connecting the services of other third parties to our website, our services or this agreement. You also understand that individuals directly related to us, such as the GoSELL company, GoSELL partners, GoSELL employees, etc., are not responsible for any damages. If you use any third-party service, you are bound by their commitments.

Our services and products are the bare minimum we provide to you and are not subject to any statutory warranty.

GoSELL does not warrant that the service we provide will be uninterrupted, secure or error-free.

GoSELL does not warrant that the quality of any products, services, information or other material purchased or obtained by you through our services will meet your expectations if any errors occur born, we will fix it within allowable conditions.

Article 6: Abandon and complete the commitment

If GoSELL makes an error or does not comply with any provision stated in these Terms of Use, it does not mean that it is canceled. We will continuously update the Terms of Use in a direction that brings the best benefits to both our customers and us.

These Terms of Use are deemed to be the entire agreement between you and GoSELL and govern your use of our services (without limitation on any version of these Service Term).

Article 7: Intellectual property and customer content

All GoSELL websites and applications provided to you are copyrighted and owned by our service provider, a subsidiary of Mediastep Software Inc., headquartered in Vancouver, BC, Canada.

We do not claim any intellectual property rights over the materials you provide for GoSELL services. All materials you post on your website (through GoSELL's services) are your sole property. You can delete your store at any time by deleting your account. This also means you delete all the content you are storing on our service.

By uploading your content to your store, you agree to:

(a) Allow other Internet users to view content on your website.

(b) Allow GoSELL to display and store such content.

(c) GoSELL may view the data you have uploaded.

You retain ownership of all content on your website when you download it to our account. However, by uploading your content, you agree to allow others to view your uploads. You are responsible for whether all content you upload complies with the law or not.

We will not disclose any of your information to third parties, except in necessary cases, such as a dispute over the right to use the service. Confidential information includes any documents or information you provide to us that you do not want the public to know. Confidential information does not include:

(a) Was made public at the time we received it;

(b) Come from domains that have been made publicly available after our receipt but are not due to our fault;

(c) We receive your information from more than one person;

(d) Required by law.

Article 8: Register e-commerce website with the Ministry of Industry and Trade

GoSELL recommends that customers register an e-commerce website for the domain name they purchased through GoSELL or currently own with the Ministry of Industry and Trade of Vietnam if they have e-commerce activities in Vietnam.

GoSELL DOES NOT support customer registration.

Article 9: Cancel service

You can cancel your account at any time by emailing us at [email protected] and we will then send you detailed instructions.

Once the cancellation order is confirmed, all content on your website will be immediately deleted.

If you cancel your service midway through your billing cycle, you will receive full billing notification information via email. We will not refund the current charges.

Article 10: Modification of services and prices

Costs for using GoSELL will be notified 30 days in advance if there are any changes.

GoSELL reserves the right to change or update GoSELL services.

GoSELL is not responsible for you or any third party when they change their prices or discontinue their services.

Article 11: Optional tools

GoSELL may provide you with access to tools from other third parties with whom GoSELL has connected.

You understand and agree that GoSELL provides the right to use these companies without any warranty or representation. GoSELL does not bear any responsibility related to third parties.

Any actions taken by your third parties will be your sole responsibility. We advise you to research carefully and listen to advice from previous users to have a better grasp when using the services of third parties.

Article 12: Privacy policy

Purpose and scope of collection

The main data collection on GoSELL includes email, phone, login name, login password, and user address. GoSELL needs members to provide this information because this is mandatory information when registering to use the service and for GoSELL to contact for confirmation when customers register to use the service on the website to ensure their benefit as consumers.

Members will be responsible for the security and storage of all service usage activities under their registered name, password and email. In addition, members are responsible for promptly notifying the GoSELL multi-channel sales management platform about unauthorized use, abuse, security violations, and retention of registration names and passwords by third parties to have appropriate solutions.

Scope of information use

The GoSELL multi-channel sales management platform uses information provided by members to:

- Providing services to members;

- Send notifications about information exchange activities between members and the GoSELL multi-channel sales management platform;

- Prevent activities that destroy members' user accounts or activities that impersonate members;

- Contact and resolve with members in special cases.

- Do not use members' personal information for anything other than confirmation and contact information related to transactions at GoSELL.

- In cases of legal requirements, the GoSELL multi-channel sales management platform is responsible for cooperating in providing personal information to members upon request from judicial authorities, including procurement, courts, and police agencies related to certain legal violations by customers. In addition, no one has the right to infringe on members' personal information.

Information storage time

The member's data will be stored until a cancellation is requested or the member logs in and makes the cancellation. In all other cases, member's personal information will be kept confidential on GoSELL's server.

Means and tools for Users to access and edit their data

Members have the right to check, update, adjust or cancel their personal information by logging into their account and editing personal information or asking GoSELL to do this.

Members have the right to submit complaints about personal information disclosure to third parties to GoSELL's Management Board. When receiving this feedback, GoSELL will confirm the information is responsible for answering the reason and instruct members to restore and re-secure the information.

Committed to protecting customer personal information

GoSELL members' personal information on GoSELL is committed to absolute confidentiality according to GoSELL's personal information protection policy. The collection and use of each member's information are carried out with that member's consent, unless otherwise prescribed by law.

Do not use, transfer, provide or disclose to any third party the member's personal information without the member's consent.

In case the information server is attacked by hackers, leading to the loss of personal data, GoSELL will be responsible for reporting the incident to the investigating authorities for timely handling and notifying members.

Secure all members' online transaction information, including digital accounting invoice information and documents, at GoSELL's level 1 secure central data area.

The GoSELL Management Board requires individuals, when registering/purchasing to be members, to provide all relevant personal information, such as their full name, contact address, email, ID number, phone number, account number, payment card number, etc., and is responsible for the legality of the information. GoSELL Management Board is not responsible, nor will it resolve any complaints related to that member's rights if it deems that all of that member's personal information provided upon initial registration is inaccurate.
